Data Sharing Agreements and Restricted Data Requests

The Arizona Department of Education receives requests for data that is not available through publicly accessible reports, dashboards, or published datasets. When the information you need cannot be found in ADE's public data resources, there are two options for requesting non-public data: a Data Sharing Agreement (DSA) or a Restricted Data Request.

Both Data Sharing Agreements and Restricted Data Requests allow access to data that is not publicly available. However, they serve different purposes and are intended for different types of requests. Understanding the differences will help you determine which option best fits your needs.

A Data Sharing Agreement (DSA) is intended for research that require access to student-level data or ongoing access to confidential information for approved research purposes.

DSAs are most commonly requested by:

  • Researchers
  • Universities and research organizations
  • Graduate students
  • Doctoral students conducting dissertation research

A DSA may be appropriate when:

  • The request includes student-level data.
  • The request supports research requiring access to confidential or sensitive data.
  • Data will be provided on a yearly basis throughout the life of a research project.
  • Ongoing access to data is necessary to complete the approved work.

Student-level records can only be shared through a Data Sharing Agreement. To protect student privacy and maintain data security, approved users access student-level data through a secure virtual machine environment rather than receiving the data directly.

Data Sharing Agreements are approved for a defined period and may remain active for up to five years before requiring renewal and review.

A Restricted Data Request is intended for one-time requests that do not require student-level data.

Restricted Data may be appropriate when:

  • The request is for a one-time data delivery.
  • Student-level information is not needed.
  • The requested data can be provided in an aggregated format.
  • Small cell counts can be suppressed or redacted to protect privacy.
  • Summary-level information will meet the needs of the request.

Restricted Data Requests are often used when a requester needs information that is not publicly available but can still be provided.

 Review and Approval Process

Both Data Sharing Agreements and Restricted Data Requests must be reviewed and approved by the Data Governance Council before any data can be released.

The Data Governance Council reviews each request based on a variety of considerations, including but not limited to student privacy, legal and regulatory obligations, the purpose of the request, data availability, and the program area's capacity to fulfill the request.

FERPA permits an educational agency or institution to disclose Personally Identifiable Information from an education record of a student if the disclosure meets one or more of the conditions outlined in 20 U.S.C. §1232g(b) and (h) – (j) and 34 CFR § 99.31.

Request Terms and Conditions
I have reviewed the publicly available data sets and found that the information I am requesting is not included in this request. FERPA Notice Please note that all information provided through a Public Record Request is reviewed and released in accordance with the Family Educational Rights and Privacy Act (FERPA) and ADE Policy. The purpose of FERPA is two-fold: to assure that parents and eligible students can access the student’s education records, and to protect their right to privacy by limiting the transferability of their education records without their consent. 120 Cong. Rec. 39862. As such, FERPA is not an open records statute or part of an open records system. The only parties who have a right to obtain access to education records under FERPA are parents and eligible students. Journalists, researchers, and other members of the public have no right under FERPA to gain access to education records for school accountability or other matters of public interest, including misconduct by those running for public office. Nonetheless, as explained in the preamble to the NPRM, 73 FR 15584–15585, we believe that the regulatory standard for defining and removing personally identifiable information from education records establishes an appropriate balance that facilitates school accountability and educational research while preserving the statutory privacy protections in FERPA. The simple removal of nominal or direct identifiers, such as name and SSN (or other ID number), does not necessarily avoid the release of personally identifiable information. Other information, such as address, date and place of birth, race, ethnicity, gender, physical description, disability, activities and accomplishments, disciplinary actions, and so forth, can indirectly identify someone depending on the combination of factors and level of detail released. Conditions: The requestor acknowledges receipt of information as described above, understands that it may include sensitive or personal or confidential information, and accepts responsibility for safeguarding it as appropriate. The undersigned is aware of the Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. §1232g; 34 CFR Part 99), understands that it is a federal law that protects the privacy of student educational records, and recognizes that there are severe penalties for its violation.
