Arizona Department Of Education (ADE) Public Notice and Comment Period

Title IV, Part A FY 21 Waiver Request: Public Comment Opportunity

As part of waiver requirements, ADE is posting an opportunity for public comment regarding its request to waive expenditure requirements and increase flexibility for Title IV, Part A "Student Support & Academic Enrichment Grant" for the 2020-2021 school year. The following waivers are being proposed due to COVID-19: 

  • Section 4106(e)(2)(C), (D), and (E) of Title IV, Part A of the ESEA, with respect to content-area spending requirements for Federal fiscal year (FY) 2020 Title IV, Part A funds.
  • Section 4109(b) of Title IV, Part A of the ESEA, with respect to the fifteen percent spending limitation for technology infrastructure for FY 2020 Title IV, Part A funds.

The U.S. Department of Education requires state educational agencies, when seeking waivers from statutory or regulatory requirements, solicit and respond to public comment on the request and provide evidence of the available comment period. This 15-day public comment period will be open from December 9, 2020, and conclude on December 23, 2020, at 5:00 pm. 


NOTICE OF PUBLIC COMMENT PERIOD: 

 

Any individual or organization may submit written comments on the proposed waiver pursuant to 34 C.F.R. §200.6(c)(4). Written comments shall be accepted until December 23, 2020.

Requirements from which Arizona is seeking a waiver include:

  • Section 4106(e)(2)(C), (D), and (E) of Title IV, Part A of the ESEA, with respect to content-area spending requirements for Federal fiscal year (FY) 2020 Title IV, Part A funds.
  • Section 4109(b) of Title IV, Part A of the ESEA, with respect to the fifteen percent spending limitation for technology infrastructure for FY 2020 Title IV, Part A funds.

Please note that all other requirements in Title IV, Part A of the ESEA would continue to apply.
