CDC Moratorium Update

The federal CDC moratorium is in place until December 31, 2020. Renters need to follow specific steps to use the moratorium, including providing a written declaration to their landlord, and all rent continues to be due. In October, new CDC moratorium guidance was issued that confirmed landlords can proceed with filing evictions and may challenge tenant declarations in court. However, renters can use the CDC moratorium to stop enforcement of the eviction, the final stage of the eviction process when the constable comes to the property.

After December 31, landlords can proceed with enforcing evictions.  At that time, it remains unclear how many evictions will be enforced in Arizona, but national partners predict millions of households are at risk of losing their homes when the moratorium lifts.

Please continue to educate families  on the CDC moratorium process and to apply for rental assistance if they are unable to make rent payment. The Arizona Housing Coalition CDC Eviction Moratorium Summary explains the steps a renter needs to take to use the CDC moratorium and our List of Known Rental Assistance Resources and Eviction Prevention Programs can be used to identify available rental assistance funds statewide. This list is being updated every two weeks in partnership with the Crisis Response Network.
